Acceptance of Terms

By accessing or using the FAHREN TERMITOR website (“Site”), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service (“Terms”). These Terms constitute a legally binding agreement between you and FAHREN TERMITOR regarding your use of the Site and access to content related to automotive LED lighting products, including LED headlights, fog lights, and other vehicle lighting solutions.

Indemnification

You agree to defend, indemnify, and hold harmless FAHREN TERMITOR, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to:

  • Your User Content
  • Your use of the Site
  • Your use of any information obtained from the Site
  • Your violation of any third-party right
  • Your violation of any applicable law, rule, or regulation
  • Any claim that your User Content caused damage to a third party
  • Any activities conducted through your account (if applicable)

This indemnification obligation will survive these Terms and your use of the Site. FAHREN TERMITOR reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of these claims.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which FAHREN TERMITOR is established, without regard to its conflict of law provisions. You agree that any legal action or proceeding between you and FAHREN TERMITOR shall be brought exclusively in the courts located in that jurisdiction.

In the event of any dispute arising out of or relating to these Terms or your use of the Site, you agree to first attempt to resolve the dispute informally by contacting FAHREN TERMITOR. If we are unable to resolve the dispute informally, both parties agree to resolve the dispute through binding arbitration in accordance with the rules of the arbitration association of the jurisdiction where FAHREN TERMITOR is established.

Any arbitration shall be conducted in the English language and shall take place in the jurisdiction where FAHREN TERMITOR is established. The arbitrator’s award shall be binding and may be entered as a judgment in any court of competent jurisdiction.

Notwithstanding the foregoing, FAHREN TERMITOR reserves the right to seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights.

Termination and Modification

FAHREN TERMITOR reserves the right, in its sole discretion, to terminate your access to all or part of the Site, with or without notice and for any reason, including, without limitation, breach of these Terms. FAHREN TERMITOR may also, in its sole discretion and at any time, discontinue the Site or any part thereof, with or without notice, or may modify or revise these Terms from time to time.

The most current version of these Terms will be posted on the Site with the “effective date” posted at the top. FAHREN TERMITOR may also, in its sole discretion, notify you of any significant changes by posting a notice on the Site’s homepage. Your continued use of the Site after any modifications to the Terms indicates your acceptance of the modified Terms.

If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent necessary so that the remaining provisions of the Terms will continue in full force and effect.

Upon termination, all provisions of these Terms which, by their nature, should survive termination, shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
